REFUNDS FROM BALANCE
Over-funded balance can be refunded within 30 days of the payment that resulted in the over-funding. In special cases, other payments can be refunded instead of the original payment if the 30-day time-frame can be applied to those payments.CHARGEBACKS
If at any time, we record a decline, chargeback, reversal, payment dispute, risk of payment fraud or other rejection of a charge of any payable fees on your Hostinger account (“Chargeback”), this will be considered as a breach of your payment obligations hereunder, therefore you agree that Hostinger may pursue all available lawful remedies in order to obtain payment, including but not limited to, immediate termination, without notice to you, of your Hostinger account and any domain names or Hostinger services registered or renewed on your behalf (“Services”). In addition, this will also result in disabling the option to checkout with a credit card for your Hostinger account to limit the risk of payment fraud. In the event a Chargeback is performed, your Hostinger account may be blocked without the option to re-purchase or re-use it, and any data contained in such a Hostinger account, including any certain content, features, or capacity of your Hostinger account may be subject to cancellation and loss of data. Your use of the Hostinger Services and the ability to checkout using credit card will not resume until you:- verify the payment method used for the disputed transaction, either by providing:
- proof of the payment; or
- a simple censored photo of the credit card, with uncovered first 6 (six) and last 4 (four) digits.
- pay any applicable fees in full, including any fees and expenses incurred by Hostinger and/or any third party services for each Chargeback received (including fees for Hostinger Services provided prior to the Chargeback, handling and processing charges and fees incurred by the payment processor).

Whether you are the holder of a trademark, service mark, or copyright, social-hosting is committed to helping you protect your legal rights. Therefore, we have established the following policies for considering trademark and/or copyright infringement claims.
Domain Name Dispute Claims
Please refer to the Uniform Domain Name Dispute Resolution Policy (the “UDRP”) if you have a concern or dispute about a registered domain name. Any dispute regarding the registration of domain names will need to be sent either to the registrant or to an ICANN-approved arbitration provider. This Trademark/Copyright Infringement policy specifically excludes domain name disputes and has been established to allow reporting of possible violations involving other social-hosting products and services.Copyright and Trademark Claims
- To notify social-hosting that there has been a copyright or trademark violation, please follow the specific instructions in (A) for filing a trademark claim, or (B) filing a copyright complaint.
- If you are responding to a complaint of infringement, you will need to follow our Counter Notification policy in (C).
- The trademark, service mark, trade dress, name, or other indicia of origin (“mark”) that is claimed to be infringed, including registration number.
- The jurisdiction or geographical area to which the mark applies.
- The name, post office address and telephone number of the owner of the mark identified above.
- The goods and/or services covered by or offered under the mark identified above.
- The date of first use of the mark identified above.
- The date of first use in interstate commerce of the mark identified above.
- A description of the manner in which the Complaining Party believes its mark is being infringed upon.
- Sufficient evidence that the owner of the website that is claimed to be infringing is a social-hosting customer.
- The precise location of the infringing mark, including electronic mail address, etc.
- A good faith certification, signed under penalty of perjury, stating:
- The content of the website [identify website] infringes the rights of another party,
- The name of such said party,
- The mark [identify mark] being infringed, and
- That use of the content of the website claimed to be infringing at issue is not defensible.
- An electronic signature of the copyright owner, or a person authorized to act on behalf of the owner, of an exclusive copyright that has allegedly been infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works on that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit social-hosting to locate the material.
- Information reasonably sufficient to permit social-hosting to contact the Complaining Party, such as an address, telephone number, and, if available, an electronic mail address at which the Complaining Party may be contacted.
- A statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is the owner, or is authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
- For Copyright Claims, upon receipt of appropriate notification from the Complaining Party, pursuant to Section 1 of Copyright Claims above, social-hosting will initiate an investigation and forward the Complaining Party’s written notification to the alleged infringer. While social-hosting is investigating the claim, social-hosting, at its sole discretion and without any legal obligation to do so, may notify the alleged infringer it will lock down the domain name(s), redirect the DNS, and/or if it is solely stored on a social-hosting server, temporarily remove or deny access to the allegedly infringing material.
- If social-hosting concludes that the Complaining Party has raised a legitimate copyright claim, it will continue to suspend the alleged infringer’s social-hosting account and/or if it is solely stored on a social-hosting server, deny access to the allegedly infringing material. If social-hosting concludes that the Complaining Party has not raised a legitimate claim, social-hosting will restore access to the allegedly infringing material.
- Counter Notification.If you have received a notice of copyright or trademark infringement that you wish to challenge based on a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled, you may provide Counter Notification by emailing abuse@najhosting.com and including the following:
- An electronic signature of the alleged infringer.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that the alleged infringer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The alleged infringer’s name, address, and telephone number, and a statement that the Infringer consents to the jurisdiction of the Federal District Court for any judicial district in which social-hosting may be found, and that the alleged infringer will accept service of process from the Complaining Party or an agent of such Party.
- Upon receipt of a Counter Notification as described in Section 1 above, social-hosting shall promptly provide the Complaining Party with a copy of the Counter Notification, and inform such Party that it will cease disabling access to it in ten (10) business days. social-hosting will replace the removed material and cease disabling access to it in not less than ten (10), nor more than fourteen (14), business days following receipt of the Counter Notification, unless social-hosting first receives notice from the Complaining Party that such Complaining Party has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on social-hosting’s system or network.

1. Social-hosting’s trademarks, service marks, logos, trade dress, web design, and other brand features (“Brand Characteristics”) are protected by applicable trademark, copyright and other intellectual property laws.

How to Submit the complaint- Complainant needs to fill the whois reporting form available at https://www.najhosting.com/contact
- Enter the domain name and describe the whois inaccuracy.
- Enter you name and email address on which you wish to receive our reply.
- Click send.
- Our Abuse team will send a mail to the Registrant of the domain name asking them to correct the whois details of their domain name within the 7 days.
- If the Registrant fails to modify the whois details / fails to update the registrar with the sufficient proof to prove that the current / modified whois details are accurate; the domain name will be suspended for whois inaccuracy after the allotted 7 day period gets over.
SPAM
How to Submit the complaint- Complainant needs to fill the spam reporting form available at https://www.najhosting.com/contact
- Enter the domain name and COMPLETE headers & body of the spam mail. Message headers & body are the most important proof of the spam and without it we cannot verify the complaint.
- Enter you name and email address on which you wish to receive our reply.
- Click Send.
- Our Abuse team will verify the spam headers/body to determine from where the spam was originated and the Type of spam.
- In case of compromised/hacked domain scenario and first promotional spam instance, a warning will be sent to the domain registrant. Subsequent spam complaint will result in suspension of the domain.
- In case of deliberate phishing / 419 scam / Malware distribution, the domain name will be suspended directly.

- Enter the domain name and the detailed complaint. Complaint should include details of abuse along with the evidence to support it.
- Enter your name and email address on which you wish to receive our reply.
- Click Send.
- Our Abuse team will go through the complaint to determine the type of the abuse.
- In case of compromised/hacked domain, a warning will be sent to the domain registrant. If the registrant fails to remove the unauthorized content, the domain name will be suspended.
- In case of deliberate abuse like phishing / Malware / 419 scam / Child Pornography the domain name will be suspended directly.
DATA REQUEST POLICY
- Types of Requests. We receive the following types of requests concerning customer data:
- Data Requests. A data request is a request for information or documents relating to customer accounts in connection with official criminal investigations or other official legal proceedings. Except in limited emergency situations (see below), we require data requests to be made through formal U.S. legal process and procedures, and we respond to such requests as required by law. Examples of data requests include:
- Subpoenas
- Court Orders
- Search Warrants
- Legal process received from outside the United States may require a Mutual Legal Assistance Treaty (MLAT) with the United States
- Other forms of legal process such as Civil Investigative Demands
- Preservation Requests. A preservation request asks social-hosting to preserve customer account records in connection with official criminal investigations or other official legal proceedings. Preservation requests must include the following information:
- Identification of the account(s) at issue (as further described in Section 4 below);
- Identification of the investigating agency and/or specific pending official proceedings (requests must be signed on law enforcement letterhead );
- Assurances that the requesting agency or individual is taking steps to obtain appropriate legal process for access to the data that we are being asked to retain; and
- A valid return email address and phone number.
- Emergency Requests. An emergency request is only appropriate in cases involving imminent serious bodily harm or death. We respond to emergency requests when we believe in good faith that such harm may occur if we do not respond without delay. Notice to Customers. Our policy is to notify customers of requests for their data unless we are prohibited from doing so by statute or court order. Information to Include in a Request. The following information must be included in a request for customer data:
- First and last name of the customer and email address associated with the account; and
- Domain name and/or IP address associated with the account. We may not be able to respond to a request without this information. - Fees. We may seek reimbursement for costs in responding to requests as provided by law and may charge additional fees for costs in responding to unusual or burdensome requests.
